Terms of Service

Please read these terms carefully before using CustomSubs. By using the app, you agree to be bound by these terms.

1. Agreement to Terms

By downloading, installing, or using the CustomSubs mobile application ("App," "Service," or "CustomSubs"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and CustomApps LLC ("Company," "we," "us," or "our").

2. Description of Service

CustomSubs is a privacy-first, offline-only subscription tracking application that helps you:

  • Track recurring subscription charges
  • Receive local notification reminders before billing dates
  • Manage cancellation information
  • Analyze spending across subscriptions
  • Export and import subscription data

Key Service Characteristics:

  • Offline-Only: All features work without internet connection
  • No Account Required: No registration, login, or user account needed
  • Local Storage: All data stored exclusively on your device
  • Free to Use: No subscription fees, in-app purchases, or advertisements

3. Eligibility

You must be at least 13 years of age to use CustomSubs. If you are under 18, you must have permission from a parent or legal guardian to use the App.

By using CustomSubs, you represent and warrant that:

  • You meet the age requirements above
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

4. License Grant

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use CustomSubs on devices you own or control, solely for personal, non-commercial use.

4.2 Restrictions

You may NOT:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works based on the App
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Use the App in any way that could harm, disable, overburden, or impair our services
  • Attempt to gain unauthorized access to any part of the App
  • Use the App to violate any third-party rights

4.3 App Store Terms

If you download CustomSubs from the Apple App Store or Google Play Store, you also agree to the applicable app store's terms of service. In the event of a conflict between these Terms and app store terms, the app store terms will control with respect to your use of the App via that store.

5. User Responsibilities

5.1 Accurate Information

You are responsible for:

  • Entering accurate subscription information (amounts, dates, etc.)
  • Verifying billing dates and charges with your actual service providers
  • Updating subscription information when terms change

CustomSubs is a tracking tool only. We do not verify, guarantee, or confirm the accuracy of the information you enter.

5.2 Data Backup

You are responsible for:

  • Regularly exporting backups of your subscription data
  • Securely storing exported backup files
  • Maintaining copies of important information

We are NOT responsible for data loss due to:

  • Device failure, loss, or theft
  • App uninstallation without prior backup
  • Device reset or factory restore
  • iOS/Android system updates
  • Any other cause

IMPORTANT: Data is stored locally on your device only. If you lose your device or uninstall the app without exporting your data, we CANNOT recover it.

5.3 Notification Limitations

While CustomSubs is designed to reliably schedule local notifications:

  • We do NOT guarantee notifications will always fire
  • Operating system restrictions may prevent notifications (battery optimization, Do Not Disturb mode, notification permissions denied, etc.)
  • You remain responsible for tracking your subscriptions and charges
  • Notifications are a helpful reminder, not a guarantee

You should not rely solely on CustomSubs notifications for financial management. Always monitor your bank statements and service provider communications.

5.4 Cancellation Assistance

CustomSubs provides cancellation information (URLs, phone numbers, checklists) as a convenience. However:

  • We do NOT cancel subscriptions on your behalf
  • Information may be outdated or inaccurate
  • You are responsible for following through with cancellations
  • We are NOT liable for failed cancellations or unwanted charges

6. Intellectual Property

6.1 Our Rights

CustomSubs and all related content, features, and functionality (including but not limited to software, design, text, graphics, logos, and icons) are owned by CustomApps LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Your Data

You retain all rights to the subscription data you enter into CustomSubs. We claim no ownership or intellectual property rights over your data.

When you export your data as a JSON file, that file and its contents belong to you entirely.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about CustomSubs ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our products and services without any obligation to compensate you.

7. Disclaimers and Limitations of Liability

7.1 No Financial Advice

CustomSubs is a subscription tracking tool only. It does NOT provide:

  • Financial advice or recommendations
  • Tax preparation or advice
  • Budgeting or financial planning services
  • Verification of charges or billing disputes

Always consult qualified professionals for financial, tax, or legal advice.

7.2 "As Is" and "As Available"

CUSTOMSUBS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, completeness, or reliability
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

We do not warrant that:

  • The App will meet your requirements
  • The App will be available at all times
  • The App will be free from bugs or errors
  • Notifications will always fire reliably
  • Stored data will never be lost or corrupted

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CUSTOMAPPS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  1. Indirect, Incidental, Special, Consequential, or Punitive Damages
  2. Loss of Profits, Revenue, Data, or Use
  3. Missed Subscription Charges or Late Fees
  4. Failed Cancellations or Unwanted Charges
  5. Device Damage or Data Loss
  6. Any Other Damages or Losses

ARISING OUT OF OR RELATED TO YOUR USE OF CUSTOMSUBS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.4 Maximum Liability

IF, NOTWITHSTANDING THE ABOVE, WE ARE FOUND LIABLE FOR ANY DAMAGES, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE CUSTOMSUBS IN THE 12 MONTHS PRECEDING THE CLAIM.

SINCE CUSTOMSUBS IS FREE, THIS AMOUNT IS $0.00 (ZERO DOLLARS).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless CustomApps LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  1. Your use or misuse of CustomSubs
  2. Your violation of these Terms
  3. Your violation of any third-party rights
  4. Any data you enter, store, or export via the App
  5. Any disputes with service providers or subscription services

9. Updates and Changes

9.1 App Updates

We may release updates, upgrades, or new versions of CustomSubs from time to time. These updates may:

  • Add new features
  • Fix bugs or security issues
  • Improve performance
  • Change functionality

You are responsible for installing updates. Older versions may cease to function properly or become unavailable.

9.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  1. We will update the "Last Updated" date
  2. We will notify you via an in-app message
  3. The updated Terms will be posted at customsubs.us/terms

Continued use of CustomSubs after Terms updates constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the App.

10. Termination

10.1 Termination by You

You may stop using CustomSubs at any time by:

  • Deleting the App from your device
  • Not opening or using the App

We recommend exporting your data before uninstalling.

10.2 Termination by Us

We reserve the right to:

  • Discontinue CustomSubs at any time
  • Refuse service to anyone for any reason
  • Remove the App from app stores

Since CustomSubs is fully offline and local to your device, discontinuation would not affect existing installations, but updates and support would cease.

10.3 Effect of Termination

Upon termination:

  • Your license to use CustomSubs immediately terminates
  • You must cease all use of the App
  • Sections 6 (Intellectual Property), 7 (Disclaimers), 8 (Indemnification), 11 (Dispute Resolution), and 12 (General) survive termination

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us at bobby@customapps.us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.

11.2 Binding Arbitration

If informal resolution fails, you agree that any dispute arising out of or relating to these Terms or CustomSubs shall be resolved by binding arbitration, rather than in court, except that:

  1. You may assert claims in small claims court if your claims qualify
  2. You or we may seek injunctive or equitable relief in court for intellectual property infringement

Arbitration Rules:

  • Arbitration will be conducted by the American Arbitration Association (AAA)
  • AAA's Consumer Arbitration Rules will apply
  • Arbitration will be held in Boston, Massachusetts or telephonically
  • The arbitrator's decision is binding and may be entered as a judgment in court

11.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.

11.4 Opt-Out

You may opt out of the arbitration agreement by emailing us at bobby@customapps.us within 30 days of first using CustomSubs. Your opt-out notice must include your name and state that you wish to opt out of the arbitration agreement.

11.5 Governing Law

These Terms are governed by the laws of the State of Massachusetts, United States, without regard to its conflict of law provisions.

Any arbitration or court proceeding will be conducted in Boston, Massachusetts.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CustomApps LLC regarding CustomSubs and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to be enforceable to the maximum extent possible.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

12.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and CustomApps LLC.

12.6 Force Majeure

We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, or government actions.

12.7 Export Control

You agree to comply with all applicable export and import laws and regulations. You may not use or export CustomSubs in violation of U.S. export laws and regulations.

12.8 U.S. Government Rights

If you are a U.S. government entity, CustomSubs is a "commercial item" as defined at 48 C.F.R. § 2.101, and is licensed in accordance with these Terms.

12.9 California Residents

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice:

13. Third-Party Services

13.1 App Store Providers

These Terms are between you and CustomApps LLC only, not with Apple Inc., Google LLC, or any other app store provider.

App store providers have no obligation to provide support or maintenance for CustomSubs. Any claims related to the App should be directed to us, not the app store provider.

To the extent these Terms conflict with applicable app store terms, the app store terms control regarding your use of the App via that store.

13.2 Third-Party Links

CustomSubs may provide links to third-party websites (e.g., subscription cancellation URLs). We are not responsible for:

  • The availability or content of third-party sites
  • Any transactions you conduct with third parties
  • Any damages or losses caused by third-party sites

Accessing third-party links is at your own risk.

14. Accessibility

We strive to make CustomSubs accessible to users with disabilities. If you have difficulty using the App, please contact us at bobby@customapps.us.

15. Open Source

CustomSubs may incorporate open-source software components. The licenses for these components are available within the App (Settings → Open Source Licenses).

16. Translations

These Terms may be translated into other languages for convenience. In the event of a conflict between the English version and a translated version, the English version shall prevail.

BY DOWNLOADING, INSTALLING, OR USING CUSTOMSUBS, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
